Deb: Enclosed observe several false statements from a representative of your hosting and provider, Monsterhut. You would be well advised to find an alternate hosting provider, for three reasons: 1: Monsterhut is currently engaged in litigation to retain their connectivity. I am in posession of evidence that Monsterhut's lawsuit is without merit and perjurous. So are many other Internet users. It is therefore probable that Monsterhut will lose the case, and their connectivity with it. 2: Even though Paetec is currently unable to disconnect Monsterhut, individual system administrators wishing to prevent Monsterhut from sending spam to their networks may set up packet filters or other mechanisms to prevent Monsterhut's machines from gaining unauthorized and undesired access to their machines. As a side effect, these filters will prevent users on ISPs or networks which utilize them from accessing your website. 3: Monsterhut is knowingly and intentionally violating its contract with Paetec, its upstream ISP. Do you really trust a company which has been blatantly violating the terms of one business agreement to honour the terms of the one with you? ---- end note to Deb. ---- On Thu, 6 Sep 2001, Todd Pelow - MonsterHut.com wrote: > MonsterHut does not send out or condone spam. While there is a possibility that one or more of your affiliates is falsely representing their harvested list as a permission-based list, you have been aware that people who did not request your email were getting it for quite some time. If you knowingly continue to send mailings to recipient lists provided by affiliates which you know are putting harvested addresses into the lists, you are spamming. > The recipient > {Target Snipped} has not requested removal at this time however we > are removing that address from our data base immediately. I have requested that you be removed FROM THE INTERNET. Regrettably, Paetec cannot remove you due to the temporary restraining order that your meritless and perjurous lawsuit has brought on. I wish them luck in their efforts against you. > Any further statements made by this individual are expressed with the > understanding that an attempt to defame MonsterHut is a serious crime > and can be subject to legal action. It is my understanding that, in the courts of my jurisdiction, the truth of a statement is considered a viable defense against defamation charges. I believe that this is also the case in the courts of your jurisdiction. My statements are, where stated as facts, true, and, where speculation, obviously speculation in the eyes of any reasonable person. I am willing to stand by my statements regarding you under oath, if need be. Any further statements made by Monsterhut or representatives thereof are expressed with the understanding that I reserve the right, at my option, to publish any and all communications made by Monsterhut or its representatives to me, in whole and/or in part, on the Internet and/or in physical and/or other non-Internet media. It should be clarified that my use of the word 'you' in the above missive (with the exception of the clearly-demarkated section where 'you' means a customer of monsterhut identified as 'Deborah Flaherty') refers to Monsterhut as a corporation and legal person, not necessarily to Todd Pelow specifically. It is possible, albeit unlikely, that Todd Pelow has been intentionally mislead by some person or persons and sincerely believes that the false statements he is making are true. It should also be noted that, in some jurisdictions, using the legal system for harrassment and/or threatening such use of the legal system may be itself illegal. > Thanking you in advance for your cooperation, > > The MonsterHut Team. > > > > -----Original Message----- > From: {Me snipped} [mailto:{Me snipped}] > Sent: Wednesday, September 05, 2001 7:57 PM > To: Affilate Desk > Cc: tpelow@monsterhut.com; deb@flashsales.com; debra2net@aol.com; > namehost@WORLDNIC.COM > Subject: Re: Check out this Great Affiliate Program! > > > On Wed, 5 Sep 2001, Affilate Desk wrote: > > > > > Dear Webmaster; > > > > > > My name is Deborah Flaherty, I am the Director of Channel Marketing > > for FlashSales.com.
